Biography:
Thomas J. Smith has over ten years experience defending hospitals, doctors, nurses, chiropractors, health insurers, and other health care providers in medical malpractice litigation, as well as businesses and product manufacturers in product liability, personal injury, class action, and commercial litigation. Mr. Smith has successfully defended insurance companies, medical institutions, transportation companies, medical professionals, product manufacturers, and other businesses in personal injury lawsuits in Missouri and Illinois state and federal courts.
Some of Mr. Smith’s successes include:
- Defense verdict in the City of St. Louis in a medical malpractice case tried against the largest hospital in the St. Louis area.
- Defense verdict in the City of St. Louis for a taxi cab company in personal injury litigation.
- Defense verdict in personal injury matter brought in federal district court against a local amusement park.
- Summary judgment in favor of a hospital in a medical malpractice lawsuit involving alleged misdiagnosis by emergency room personnel.
- Successfully represented healthcare professionals in matters before the State Board of Medical Examiners.
Mr. Smith has assisted in defeating a number of class action cases against Fox Galvin clients, including:
- Denial of class certification in City of St. Louis case alleging fraud in connection with taxi cab services that ultimately led to case dismissal.
- Reversal of “drive-by” nationwide class action brought against auto manufacturer that led to a nuisance value settlement.
- Dismissal of putative nationwide Madison County class action alleging billing fraud against health insurer.
In addition to being a trial attorney, Mr. Smith has lectured in the areas of risk management, lawsuit prevention, and trial strategy to hospitals, doctors, and other medical professionals.
Mr. Smith is a founding partner of Fox Galvin, LLC. He is licensed to practice in Missouri and Illinois, and is also admitted to practice in the United States District Court for the Eastern District of Missouri and the Southern District of Illinois, along with state and federal appellate courts in Missouri and Illinois. Mr. Smith received his undergraduate degree in business administration from the University of Missouri-St. Louis while a member of the University basketball team. He received his law degree from Saint Louis University in 1993.
