Biography:
For over 15 years, Tom Smith has defended hospitals, doctors, nurses, chiropractors, health insurers, and other health care providers in medical malpractice litigation, as well as businesses and product manufacturers in product liability, personal injury, class action, and commercial litigation. Mr. Smith has successfully defended insurance companies, medical institutions, transportation companies, medical professionals, product manufacturers, architects, real estate companies, and other businesses in personal injury lawsuits and commercial litigation in Missouri and Illinois state and federal courts.

Some of Mr. Smith’s successes include:

  • Several defense verdicts in the City of St. Louis in medical malpractice cases tried against the largest hospital in the St. Louis area
  • Numerous defense verdicts in the City of St. Louis for the largest taxi cab company in the City of St. Louis.
  • Defense verdict in personal injury matter brought in federal district court against a local amusement park.
  • Summary judgment in favor of a hospital in a medical malpractice lawsuit involving alleged misdiagnosis by emergency room personnel.
  • Successfully represented healthcare professionals in matters before the State Board of Medical Examiners.
  • Favorable jury verdict in personal injury claim arising from a boating accident at the Lake of the Ozarks.
  • Negotiated favorable settlements on behalf of trucking companies, intermodal operators, school bus companies and other transportation companies in personal injury claims.
  • Denial of class certification in City of St. Louis case alleging fraud in connection with taxi cab services that ultimately led to case dismissal.
  • Dismissal of punitive nationwide Madison County class action alleging billing fraud against health insurer.

In addition to being a trial attorney, Mr. Smith has lectured in the areas of risk management, lawsuit prevention, and trial strategy to hospitals, medical professionals, and transportation companies.

Mr. Smith is a founding partner of Fox Galvin, LLC. He is licensed to practice in Missouri and Illinois, and is also admitted to practice in the United States District Court for the Eastern District of Missouri and the Southern District of Illinois, along with state and federal appellate courts in Missouri and Illinois. Mr. Smith received his undergraduate degree in business administration from the University of Missouri-St. Louis while a member of the University basketball team. He received his law degree from Saint Louis University in 1993.
