ainst Mr. Smith=92s client. Although plaintiff argued the doctrine of res ip=
sa loquitur applied, the Court rejected plaintiff=92s argument and granted s=
ummary judgment. In 1999, Mr. Smith obtained a defense verdict for a local a=
musement park in a personal injury case tried in the United States District =
Court for the Eastern District of Missouri. Mr. Smith has also obtained defe=
nse verdicts for transportation companies in cases tried in the City of St. =
Louis and St. Louis County. Mr. Smith has tried and defended medical malprac=
tice lawsuits against doctors and hospitals throughout Missouri.=0D=0AIn add=
ition to being a trial attorney, Mr. Smith has lectured in the areas of risk=
 management and trial strategy to hospitals and doctors.=0D=0AMr. Smith has =
successfully defended businesses and product manufacturers in product liabil=
ity and class action lawsuits. In the past three years, Mr. Smith defeated c=
lass certification in a class action lawsuit alleging billing fraud against =
a transportation company and he defeated class certification in a putative n=
ationwide class action suit against an automobile manufacturer.=0D=0AThomas =
J. Smith is a founding partner of Fox Galvin, LLC. He is licensed to practic=
e in Missouri and Illinois, and is also admitted to practice in the United S=
tates District Court for the Eastern District of Missouri and the Southern D=
istrict of Illinois, along with state and federal appellate courts in Missou=
ri and Illinois. Mr. Smith received his undergraduate degree in business adm=
inistration from the University of Missouri-St. Louis in 1990 and his law de=
gree from Saint Louis University in 1993. He is a member of the American Bar=
 Association, Missouri and Illinois State Bar Associations, the Missouri Org=
anization of Defense Lawyers, and the Defense Research Institute.
